All Medical & Health associations & councils should unite to flight the draconian rules of
Clinical Establishment Act and National Commission of Human Resources in Health (NCHRH).
Reasons why as individual Doctors
you should actively oppose the above Laws
CLINICAL
ESTABLISHMENT ACT
1. Every institution and individual run establishment (including GP clinic) will have to compulsorily
register with the body established by state government.
2. The minimum criteria for every establishment both in instrumentation
and personnel will be prescribed by the government body.
3. A certain fee shall be charged for registration and this registration
will be valid for 5 years only.
4. Monetary penalties for non registration and non compliance shall range from Rs 10000/
to 25000/ for first offence, Rs 50000/ to 200000/ for second offence and Rs 500000/ for third offence.
5. Inspectors can
visit your clinic anytime for ensuring that you comply with all rules and regulations laid down. Thus in effect, even a SDM
can threaten you with a fine of Rs 5,00,000 on any pretext under Cl 42 (1&2).This opens up unlimited avenues for undue
extortion.
6. Doctors practicing in polyclinics or hospitals as visiting faculty shall be liable for monetary punishment
if said institution does not confirm to the rules.
7. Cl.46 provides for recovery of the fine as arrears of land revenue
from Clinical Establishment owner.
8. All clinical establishments will be expected to intervene to "stabilise" the patient
with an emergency medical condition - whether myocardial infarction or appendicitis - before transferring them. This imposes
too much responsibility on clinical establishments.
NATIONAL
COMMISSION OF HUMAN RESOURCES IN HEALTH (NCHRH)
1. The Commission, National Board for Health Education and the
National Evaluation and Assessment Committee shall consist of only appointed persons derived from medical as well as non-medical
fields (e.g.engineering,business, law etc.)
2. Renewal of registration every ten years opens up another avenue of exploiting
the doctors by raising flimsy objections in the papers submitted for renewal, delaying renewal in red-tapism and asking for
bribes.( Not required in any other profession).
3. Schedule VII (Professional Misconduct) incorporates many arbitrary and
illogical clauses not supported by the established ethical norms of medical practice the world over.
4. On pronouncing
a Doctor guilty of Professional Misconduct, The National Medical Council can impose a monetary penalty of upto cash 10 Lakhs
and/or force the Doctor to do a compulsory period of Professional Service for a specified time.(Cl 69)
5. A Doctor can
not seek protection of his fundamental rights in a court of law; Cl.100 bars jurisdiction of Courts.
6. High monetary penalty
(upto cash 10 Lakhs) with another provision for letting off lightly (Cl 69) with a reprimand only speaks volumes in intended
extortion (Either one pays up the extortion money or risks suffering heavy fine and/or suspension/removal from the National
Medical Register with no recourse open to seek legal remedy)
7. A health practitioner shall be deemed guilty of professional
misconduct, if he
a) is found absent on inspection from the place of duty on two occassions ( Sch.VII Part II Cl 21,22)
on inspection.
b). fails to keep moneys of his patient in separate bank accounts and spend them for the intended purpose
within a specified time.(Sch.VII,Part I cl.20).
c). fails to obtain sufficient information which is necessary for expression
of an opinion or its exceptions are sufficiently material to negate the expression of an opinion.(Sch.VII,Part I cl 18).
d).
Clause 108 empowers the Central Government to amend (i.e. including newer clauses in Sch.VII defining professional misconduct,
for example) any of the schedules without seeking subsequent approval from the Parliament.
A BLEAK FUTURE FOR HEALTHCARE
IN INDIA:
In an atmosphere vitiated by such Draconian legislations as CEA 2010 and NCHRH Bill 2011, by an apparently
vindictive Central Government, it is not surprising if we find less and less youths aspiring to become Doctors and those already
MBBS, opting for other career options in business and administration
